When an independent investigator helps
Organizations bring in an independent investigator when a complaint involves senior people, is complex or sensitive, or when internal investigators may not be seen as neutral. An outside investigator can help the process be, and be seen to be, fair.
The usual steps
- Intake and conflict check: the scope and mandate are agreed in writing.
- Investigation procedure: allegations, witnesses and documents are identified.
- Interviews: the complainant, the respondent and witnesses are interviewed, and the respondent is told the allegations and given a chance to respond.
- Evidence review: findings are made on the balance of probabilities.
- Written report: clear, impartial findings based on the evidence.
Fairness for everyone involved
A fair investigation is timely, confidential to the extent possible, trauma-informed and free of bias. Participants are treated with respect and can usually bring a support person to interviews. The investigator does not take sides.
Investigations in sport
Sport organizations increasingly need independent investigations of complaints under safe-sport policies and codes of conduct. The same principles of fairness, independence and clear reasoning apply.
